Liability Insurer for Design/Construction Team

This international airport underwent a $1.4 billion staged construction of a new international air passenger terminal with a 54-month project schedule. The new facility replaced an existing air terminal in the same location, which had to maintain operations in the original structure during construction.

After the completion of the project, the developer formulated a $136 million claim against the design professionals and the construction manager. The claim alleged damages for project delay and errors and omissions as a result of the design and construction professionals' failure to meet the standard of care.

Helmes&Co was retained by the design and construction professionals' liability insurer to analyze the overall program schedule and submitted change orders, and to develop a portal-based document management system, which was used to examine the numerous schedule and error and omission issues.

Our consultants developed a detailed schedule analysis to determine and quantify the actual impacts to the project's critical path and utilized the results of this analysis to perform a focused examination of the root cause of the critical path delays. We also reviewed and responded to the error and omission claim prepared by the developer and examined the change orders that comprised this portion of the claim.

The matter settled favorably for our client during mediation proceedings.
