This museum is an unconventionally designed structure with sloping walls and ceilings and a complex building envelope.

Not long after the museum opened to the public, water damage was routinely occurring during rain and snow events. The general contractor was tasked to perform repairs. However, part of the scope of the owner-requested repair work was deemed beyond necessary by the general contractor. The owner remained adamant that its requested repairs be performed.

Helmes&Co was retained by the design team's professional liability insurer to provide dispute avoidance and resolution services, including investigative engineering and repair-related management services.

We evaluated the alleged design and construction deficiencies and proposed repair efforts related to the observed water damage. Additionally, we assembled and led a peer review team of renowned experts to help resolve the disputes.

  • Administering the distribution of insurance proceeds
  • Performing analyses
  • Developing policies and regulations, such as an ongoing inspection protocol
  • Facilitating discussions with the owner, contractor, and designers

The creative resolutions we proposed helped the parties focus on solutions rather than their divergent views. These discussions were further enhanced by clarifying presentations that we and the peer review team made to the various stakeholders.
